Terms of Service

1. Introduction and Acceptance
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you”) and ChatToSite spółka z o.o., a company registered in Poland, with its registered office at Gen. Luciana Żeligowskiego 32/34, 90-643 Łódź, Poland (“ChatToSite,” “we,” “us”).
By creating an account or using any part of the ChatToSite platform (the “Service”), you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.
2. Eligibility
You must be at least 16 years of age to use the Service. If you are between 16 and 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Service, you represent and warrant that you meet these requirements.
3. Description of the Service
ChatToSite is an AI-powered website builder platform that provides:
- AI-assisted generation and editing of websites (frontend and backend functionality);
- A browser-based development environment powered by WebContainer technology, which executes build tools and a development server locally within your browser using WebAssembly;
- Domain name registration and management through our third-party registrar partner (Dynadot);
- Website hosting and deployment via Cloudflare Pages;
- Form submission handling and email notification delivery.
4. Account Terms
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide a valid email address for account creation. You agree to notify us immediately of any unauthorized use.
We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms or our Acceptable Use Policy.
5. AI-Generated Content
The Service uses artificial intelligence to generate website code, text, and design elements. AI-generated content is provided on an “AS IS” basis. ChatToSite makes no representations or warranties regarding the accuracy, completeness, legality, or suitability of AI-generated content.
You are solely responsible for reviewing, testing, and ensuring that any AI-generated content deployed to your website complies with applicable laws, does not infringe third-party intellectual property rights, and does not contain defamatory, misleading, or otherwise harmful material. ChatToSite shall not be liable for any claims, damages, or losses arising from the use or publication of AI-generated content.
6. Browser-Based Development Environment
The Service utilizes WebContainer technology to run a development environment directly in your web browser. This involves executing JavaScript, installing npm packages, and running a local development server within a sandboxed WebAssembly environment in your browser. By using the Service, you consent to these browser-based operations, which are necessary for the core functionality of the platform.
7. Domain Registration
Domain names purchased through ChatToSite are registered via our third-party registrar partner, Dynadot, under ChatToSite’s registrar account on your behalf. This means:
- ChatToSite acts as a reseller. The domain is managed within our Dynadot account, not your personal Dynadot account.
- You retain the right to transfer the domain away at any time to any registrar of your choice using the Transfer feature in your domain management panel.
- Domain registrations are for a period of one (1) year from the date of purchase.
- Domains are not automatically renewed. It is your sole responsibility to renew your domain before its expiry date. We will send courtesy email reminders at 30, 7, and 1 day(s) before expiry, but these are informational only and do not constitute a guarantee of notification.
- If you fail to renew a domain before expiry, the domain may be lost permanently, and ChatToSite bears no liability for such loss.
- Domain purchases are non-refundable. Once a domain is registered with the registrar, the registration fee cannot be reversed.
- Domain renewal costs are charged to ChatToSite’s registrar account balance and may differ from the original registration price.
- WHOIS privacy protection is enabled by default for all registered domains.
8. Subscription and Billing
ChatToSite offers subscription plans (Starter, Business, Growth) billed monthly or yearly. All payments are processed by Lemon Squeezy, which acts as the Merchant of Record for our digital products.
- Subscription fees are charged in advance on a recurring basis (monthly or yearly) according to your chosen billing cycle.
- Subscriptions auto-renew unless cancelled before the end of the current billing period. You may cancel at any time through the Lemon Squeezy customer portal accessible from your account settings.
- Upon cancellation, you retain access to paid features until the end of the current billing period.
- We reserve the right to change subscription pricing with 30 days’ written notice (via email or in-app notification). Price changes will apply at the start of your next billing cycle following the notice period.
- Refunds for subscriptions are handled in accordance with Lemon Squeezy’s terms as Merchant of Record and applicable consumer protection laws.
- Free domain tokens included with yearly Business and Growth plans are subject to availability and the conditions described on the hosting page.
8.1 EU Right of Withdrawal
If you are a consumer in the European Union or the European Economic Area, you normally have the right to withdraw from a distance contract within 14 days without giving any reason (Directive 2011/83/EU, Article 9). However:
- Digital content (subscriptions): By creating a subscription and using the Service, you expressly consent to the immediate provision of digital content (access to the AI website builder, editor, and hosting features) and you acknowledge that you lose your right of withdrawal once the digital content has been made available to you (Article 16(m)).
- Domain registration: Domain registration constitutes a service that is fully performed immediately upon purchase (the domain is registered with the registrar within seconds). By completing a domain purchase, you expressly consent to immediate performance and acknowledge that you lose your right of withdrawal once the domain has been registered (Article 16(a)).
If you have not yet accessed the digital content or the service has not yet been performed, you may exercise your right of withdrawal by contacting us at hello@chattosite.com within 14 days of purchase.
9. Hosting and Deployment
Websites built with ChatToSite are deployed and hosted on Cloudflare Pages under ChatToSite’s Cloudflare account. We reserve the right to:
- Suspend or remove any hosted website that violates our Acceptable Use Policy or these Terms, without prior notice in urgent cases.
- Modify the hosting infrastructure, provided we maintain reasonable service availability.
9.1 Automated Technical Modifications
During the deployment process, ChatToSite may use artificial intelligence to automatically detect and repair build errors in your project code. These automated modifications are strictly limited to resolving technical issues that prevent successful deployment (such as missing imports, invalid syntax, or incompatible dependencies). By using the deployment features, you consent to these automated technical modifications. Such repairs are applied to your project files and persist in your account. ChatToSite makes no warranty that automated repairs will succeed or produce the desired result. Each automated repair attempt consumes AI credits from your account as described in your subscription plan.
9.2 No Service Level Agreement (SLA)
ChatToSite does not provide a Service Level Agreement. There is no guaranteed uptime percentage, response time, or support resolution time. We will make commercially reasonable efforts to maintain service availability, but the Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service depends on third-party infrastructure providers (Cloudflare, Supabase, Dynadot, Lemon Squeezy) and we are not liable for downtime, data loss, or service disruptions of any kind, whether caused by our systems or third-party providers.
10. Intellectual Property
Your Content: You retain all ownership rights to the content you create, upload, or generate through the Service (including website code, text, images, and design). You grant ChatToSite a limited, non-exclusive license to host, display, and transmit your content solely for the purpose of providing the Service.
Our Service: The ChatToSite platform, including its AI models, user interface, source code, and documentation, is owned by ChatToSite sp. z o.o. and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.
11. Acceptable Use
Your use of the Service is subject to our Acceptable Use Policy, which is incorporated by reference into these Terms. Violations may result in immediate suspension or termination of your account.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
IN NO EVENT SHALL CHATTOSITE, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your access to or use of (or inability to access or use) the Service;
- Any conduct or content of any third party on the Service;
- Any AI-generated content or automated code modifications (including build auto-repair);
- Loss of a domain name due to failure to renew;
- Unauthorized access to or alteration of your data;
- Downtime, service interruptions, or deployment failures of any kind.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO CHATTOSITE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify and hold harmless ChatToSite, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your content, your violation of these Terms, or your violation of any rights of a third party.
14. Third-Party Services
The Service relies on and integrates with third-party services including but not limited to Supabase (authentication and database), Lemon Squeezy (payment processing), Dynadot (domain registration), Cloudflare (hosting and CDN), and Resend (email delivery). Your data may be processed by these providers in accordance with their respective privacy policies. ChatToSite is not responsible for the practices or availability of third-party services.
15. Termination
You may terminate your account at any time by contacting us. We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination:
- Your right to use the Service ceases immediately.
- We may delete your account data after a reasonable retention period (typically 30 days), unless longer retention is required by law.
- Active domains may still be transferred away during the post-termination period.
- No refunds will be issued for partial subscription periods.
16. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes via email or in-app notification at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree with the changes, you must stop using the Service and close your account.
17. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Republic of Poland, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be submitted to the exclusive jurisdiction of the courts in Łódź, Poland.
If you are a consumer within the European Union, nothing in these Terms affects your rights under mandatory consumer protection legislation of your country of residence.
18. Force Majeure
ChatToSite shall not be liable for any failure or delay in performing its obligations under these Terms due to causes beyond its reasonable control, including but not limited to natural disasters, acts of government, internet or telecommunications failures, third-party service outages, cyberattacks, pandemics, or labor disputes.
19. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
20. Entire Agreement
These Terms, together with the Privacy Policy, Cookie Policy, and Acceptable Use Policy, constitute the entire agreement between you and ChatToSite regarding the use of the Service and supersede all prior agreements.
